TERMS OF SERVICE AND LEGAL NOTICES (CONDITIONS D'UTILISATION)

This document sets forth the mandatory terms for the sale of goods ("Goods") via our e-commerce platform, Golf Sommet (the "Site"). These terms govern the agreement between you (the "Buyer" or "Consumer") and the Merchant and constitute the "distance contract" required by the Quebec Consumer Protection Act (CQLR c P-40.1).
ARTICLE 1. MERCHANT IDENTIFICATION (CPA REQUIREMENT)

ARTICLE 2. PRODUCT DESCRIPTION AND PRICING

Nature of Goods: All goods offered for sale are New or used golf equipments.

Accurate Representation: The Merchant is obligated to provide an accurate and complete description of the Goods. Each product listing includes the club’s model, specifications, and a clear rating of its physical condition (e.g., Excellent, Good, Fair). The Consumer acknowledges the used nature of the Goods and accepts the condition as described.

Pricing and Taxes: The price for the Goods is the amount displayed on the Site at the time of purchase. This price is inclusive of all applicable federal Goods and Services Tax (GST) and Quebec Sales Tax (QST). All mandatory shipping, handling, or administration fees are itemized in the final checkout summary. The Merchant is legally prohibited from charging a price higher than the advertised price.

Payment: We accept [List Accepted Payment Methods, e.g., Visa, Mastercard, American Express, PayPal, Shop Pay]. Title to the Goods transfers to the Buyer upon full and cleared payment.
ARTICLE 3. CONTRACT FORMATION AND CONFIRMATION

Review and Correction: Prior to the final submission of payment, the Site provides the Consumer with an express opportunity to review and correct any errors in the order details, including the selected Goods, quantity, and shipping address, and to accept or decline the final offer.

Contract Copy (CPA Requirement): Upon conclusion of the contract (completion of purchase), the Merchant shall transmit a written copy of the contract (Order Confirmation/Invoice) to the Consumer in a format that allows easy retention and printing (e.g., via email attachment) no later than 15 days following the conclusion of the contract.
ARTICLE 4. SHIPPING, DELIVERY, AND CANCELLATION

Delivery Date: The estimated delivery date or deadline shall be specified in the order confirmation.

Cancellation for Non-Delivery (CPA Right): If the Merchant fails to deliver the Goods within 30 days following the specified delivery date, or within 30 days following the date of the contract if no date was specified, the Consumer may, by written notice (email acceptable), demand the cancellation of the contract. Upon cancellation, the Merchant must refund all sums paid within 15 days of receiving the notice.

Risk of Loss: The risk of loss or damage to the Goods is transferred to the Buyer upon delivery to the shipping carrier, provided the carrier was not chosen by the Merchant.
ARTICLE 5. LEGAL AND COMMERCIAL WARRANTY

Legal Warranty (CPA Mandate): The Merchant is bound by the legal warranty provided in the Quebec Consumer Protection Act. This warranty applies automatically and requires that the Goods must:

Be fit for the purpose for which goods of that kind are ordinarily used.

Be durable for a reasonable length of time, taking into account the price paid, the terms of the contract, and the specific condition rating disclosed in the product listing.

Conform to the description and representations made on the Site.

Latent Defects: We warrant the Goods against any latent defect (defect hidden at the time of sale) that renders them unfit for the use for which they were intended.

Commercial Return Policy (Voluntary): We offer a voluntary [Number] day return window from the date of delivery. This policy is entirely separate from and does not limit the Consumer's rights under the legal warranty.

Conditions: Returned Goods must be in the same condition as shipped. Returns must be accompanied by the original receipt.

ARTICLE 6. LIMITATION OF LIABILITY
The Merchant’s liability is strictly limited to the price of the Goods and is subject to the provisions of the Quebec Consumer Protection Act. The Merchant shall not be liable for any indirect or consequential damages arising from the use or inability to use the Goods.
ARTICLE 7. GOVERNING LAW AND JURISDICTION
This agreement, including the application of the Legal Warranty and all sales transactions, is governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any legal action or dispute arising under this contract shall be submitted to the exclusive jurisdiction of the competent courts of the Province of Quebec, Canada.
ARTICLE 8. ELECTRONIC COMMUNICATIONS
The Consumer consents to receive electronic communications from the Merchant regarding the execution of this contract, including the contract copy, invoices, and shipping updates.
